释义	不是所有违反法律和行政法规的强制性规范的民事法律行为都无效。民事法律规范可分为强制性规范和任意性规范，而强制性规范又可分为强行性规范（应当如何）和禁止性规范（不得如何）。如果合同中的约定违反的是效力性强制性规定的，则该约定则是无效的。【本文关联的相关法律依据】《民法典》第一百五十三条规定，违反法律、行政法规的强制性规定的民事法律行为无效。但是，该强制性规定不导致该民事法律行为无效的除外。违背公序良俗的民事法律行为无效。（《民法典》生效时间为2021年1月1日）
