释义	法律分析：如果不是楼下人为造成的渗漏水，都是楼上责任，楼上有责任维修到不再漏水到楼下及赔偿楼下相应的损失。经双方协调不合时，可以到到法院提起民事损害赔偿诉讼由法院鉴定受损程度并予以判定；法律依据：《中华人民共和国民法典》第八十三条给相邻方造成妨碍或者损失的，应当停止侵害，排除妨碍，赔偿损失。假若相邻方不履行法院的判决，受损方可自请施工队从楼下维修，发生的费用可向法院提出要求楼上业主赔偿。
