释义	法律分析: 出轨如果属于有配偶又与他人结婚或者明知他人有配偶而与之结婚的，那么构成重婚罪，行为人会被处二年以下有期徒刑或者拘役。如果是明知是现役军人的配偶而与之同居，构成破坏军婚罪，会被处三年以下有期徒刑或者拘役。其余情形下，当事人不需要承担法律责任。《中华人民共和国刑法》第十四条【故意犯罪】明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
