民法典无主物的规定

释义

法律主观：

我国法律对无主物处理规定有，法律没有特别规定时，按先占原则取得所有权，在法律有特别规定时，从其规定。无主物主要是指物的所有权尚未被任何人取得，不属于任何民事主体所有的物，一般包括未曾归属于任何民事主体所有的物；经所有人的意思抛弃的物；所有人不明的物等。例如漂流物、埋藏物和隐藏物等。

法律客观：

《中华人民共和国民法典》第三百一十九条拾得漂流物、发现埋藏物或者隐藏物的，参照适用拾得遗失物的有关规定。法律另有规定的，依照其规定。
