法律分析:
提出退房申请。 在购房者提出退房申请之前，最好跟开发商协商清楚，购房人可以向开发商提出的退房的方式一般分为三种挂号信、传真或者电话。 如开发商自己的责任所导致的退房，那就会是开发商自己承担退房造成的损失，包括购房的税费、房屋贷款的利息费、首付存款的利息费等等。办理退房手续。 如果是事先跟开发商已经协商好了退房的，提出退房申请之后就可以等待通知办理退房手续了，在购房者提出退房申请后的15日内，开发商应当退还买房人已经支付的全部房款，并且负责办理买房人与贷款银行解除或者终止合同的全部手续，在所述手续或者文件尚未签订前，开发商应当代替买房人向贷款银行支付每月支付的本金与利息。退还房款。退房手续办理完之后，一般需要等待一段时间之后开发商才会退款，开发商应该将全部购房款返还给购房者，并且办理完毕公积金管理机构或者贷款银行的还款手续。

《中华人民共和国民事诉讼法》 第二十三条 因合同纠纷提起的诉讼，由被告住所地或者合同履行地人民法院管辖。
