释义	法律分析：不当得利不是违法行为。不当得利的取得，不是由于受益人针对受害人而为的违法行为，而是由于受害人或第三人的疏忽、误解或过错所造成的。不当得利，是指没有合法依据，有损于他人而取得利益。不当得利人应当返还不当得利。法律依据：《民法典》第九百八十五条   得利人没有法律根据取得不当利益的，受损失的人可以请求得利人返还取得的利益，但是有下列情形之一的除外：（一）为履行道德义务进行的给付；（二）债务到期之前的清偿；（三）明知无给付义务而进行的债务清偿
