法律分析:
以劳动合同为准，如果超出劳动合同约定，就属于加班，加班时间工作，你可以主张加班工资。
法律依据:
《中华人民共和国劳动法》 第九十条 用人单位违反本法规定，延长劳动者工作时间的，由劳动行政部门给予警告，责令改正，并可以处以罚款。
《劳动保障监察条例》 第二十五条 用人单位违反劳动保障法律、法规或者规章延长劳动者工作时间的，由劳动保障行政部门给予警告，责令限期改正，并可以按照受侵害的劳动者每人100元以上500元以下的标准计算，处以罚款。
