释义	离婚财产公证是指夫妻双方对离婚财产达成协议，到公证处办理离婚财产公证。协议离婚的，离婚财产分割协议在领取离婚证后自动生效，无需办理财产公证。诉讼离婚的，法院对夫妻财产分割进行判决的，在判决书生效时，离婚财产分割生效，因此，诉讼离婚也不需要离婚财产公证。【法律依据】《公证法》第二十五条，自然人、法人或者其他组织申请办理公证，可以向住所地、经常居住地、行为地或者事实发生地的公证机构提出。
