释义	如果能证明确实是身份证上的人所写的，即使欠条上的名字不对，也可以起诉并胜诉。二审法院认为，当事人应当对自己提出的诉讼请求所依据的事实或者反驳对方诉讼请求所依据的事实有责任提供证据加以证明。欠条持有人必须向法官陈述欠条形成的事实，如果对方否认，欠条持有人必须进一步举证证明欠条形成的事实。法律依据《最高人民法院关于民事诉讼证据的若干规定》第二条规定
