释义	申请在先原则是指两个或者两个以上的申请人，在同一种商品或者类似商品上，以相同或者近似的商标申请注册的，商标局受理最先提出的商标注册申请，对在后的商标注册申请予以驳回。申请在先是根据申请人提出商标注册申请的日期来确定的，商标注册的申请日期以商标局收到申请书件的日期为准。因此应当以商标局收到申请书件的日期作为判定申请在先的标准。法律依据《中华人民共和国商标法》第二十六条
